Nyack Man Charged With Assault After Fight With Orangetown Officer

ORANGETOWN, N.Y. -- Orangetown police have arrested a 32-year-old resident of Nyack on assault and other charges following a physical altercation with an officer, authorities said.

The incident came about when a motorist, identified as Kelvin Lara, was pulled over for a traffic violation along Route 59 in Nyack on Friday about 12:35 a.m., according to officials.

A check on Lara’s license showed that he had two suspensions out of the town of Newburgh; upon speaking with Lara, the officer noticed the odor of an alcoholic beverage emanating from his breath, police report.

Lara was asked to exit his vehicle and conduct field sobriety tests, but Lara refused and became uncooperative, according to officials.

The officer attempted to arrest the suspect, who then became combative and began fighting with the officer, police report.

Lara was eventually subdued, but the officer sustained an injury during the struggle, according to officials.

The suspect was placed under arrest and transported back to Orangetown police headquarters for processing, authorities said.

Lara is facing multiple charges, including second-degree assault, a felony; resisting arrest and third-degree aggravated unlicensed operation, both misdemeanors; and driving while ability impaired, a violation, police report.

The defendant was arraigned and released on bail, police report.

He is due back in Nyack Justice Court on Tuesday, Sept. 20, according to officials.
